These terms govern your access to and use of DrawbackAI. Please read them carefully — they include important limits on what our estimates mean and on our liability.
These Terms and Conditions ("Terms") are a binding agreement between you (and the company you represent) and Stable Software, LLC, which operates DrawbackAI ("DrawbackAI," "we," "us," or "our"). By accessing or using the marketing site or the DrawbackAI application (together, the "Service"), you agree to these Terms. If you do not agree, do not use the Service.
DrawbackAI is software that matches your imports to your exports, applies US Customs' duty drawback rules under 19 USC § 1313, and produces an estimate of the refund you may be able to recover. The Service may also help you hand a claim off to a customs brokerage or filing partner for actual filing.
The numbers DrawbackAI produces are estimates. The final refund is determined by US Customs and Border Protection (CBP) through the liquidation process, and may differ from any estimate we provide. We show a confidence level and a low–high range on our estimates so you can judge them accordingly.
DrawbackAI does not provide legal, tax, customs, or accounting advice, and using the Service does not create an attorney–client or broker–client relationship. You are responsible for the accuracy of the data you submit and for your own compliance decisions. You should consult a qualified professional before relying on an estimate to file a claim.
You must be at least 18 years old and authorized to act for the business you represent. You agree to provide accurate account information, keep your credentials confidential, and remain responsible for activity under your account. Notify us promptly of any unauthorized use.

You retain ownership of the import and export data and other content you submit ("Customer Data"). You grant us a limited license to host, process, and use Customer Data to operate and improve the Service and to provide your estimates, as described in our Privacy Policy. When you direct us to share Customer Data with a filing partner, you authorize that disclosure.
Where the Service is offered for a fee, pricing is flat — we do not take a percentage of your refund. Applicable fees, billing terms, and any free tier will be described at the point of purchase or in a separate order. Fees are non-refundable except as required by law or expressly stated.
The Service, including its software, design, and content (excluding Customer Data), is owned by Stable Software, LLC and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. We may use aggregated or de-identified data that does not identify you to improve the Service.
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any estimate will match CBP's final determination.
To the fullest extent permitted by law, DrawbackAI and Stable Software, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost refunds, or lost data, arising out of or relating to the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.
You agree to indemnify and hold harmless DrawbackAI and Stable Software, LLC from claims, damages, and expenses (including reasonable legal fees) arising out of your Customer Data, your use of the Service, or your violation of these Terms or applicable law.
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. On termination, your right to use the Service ends; sections that by their nature should survive — including data ownership, disclaimers, limitation of liability, and indemnification — will survive.
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. The state and federal courts located in Michigan will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to that jurisdiction and venue.
We may update these Terms from time to time. When we make material changes, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
